Patient Terms and Conditions

1. Agreement to terms
These Terms and Conditions (“Terms”) are a legally binding agreement between Prehab Zone Pty Ltd (“we”, “us”, “our”) and you (“you”, “your”) when you register for, access, or use our online prehabilitation programs, resources, and related services (“Services”).
By creating an account, purchasing access, or using our Services, you confirm that you:
- Have read, understood, and agree to these Terms; and
- Are legally capable of entering into a binding agreement.
If you do not agree, you must not use our Services.
2. Eligibility
To use our Services, you must:
- Be at least 18 years old, or have parental/guardian consent if under 18;
- Be medically cleared by your healthcare provider for participation, if applicable;
- Provide accurate and complete registration details; and
- Promptly update us if your personal, medical, or contact information changes.
We reserve the right to refuse or revoke access if you fail to meet these requirements.
3. Nature of services and important disclaimers
- Our Services provide generalised educational content on exercise, nutrition, and preparation for surgery.
- We do not provide medical diagnosis, treatment, or prescriptions.
- Our Services are not a substitute for medical advice from a qualified health professional.
- We make no guarantees that our Services will result in specific health or surgical outcomes.
4. No medical advice & scope of service
- Prehab Zone Pty Ltd provides general health, wellness, and surgical preparation information only.
- We do not provide medical, diagnostic, therapeutic, or treatment services, and we are not a substitute for care from a qualified healthcare professional.
- Nothing in our Services should be taken as personalised medical advice or a recommendation specific to your individual circumstances.
- You must not rely on our content as a substitute for professional medical advice, diagnosis, or treatment from your treating surgeon, general practitioner, or other healthcare provider.
- Participation in our program does not create a doctor–patient or clinician–patient relationship between you and Prehab Zone Pty Ltd, or any of its employees, contractors, or representatives.
- Where you have been referred by a surgeon or other healthcare professional, such referral does not alter the scope of our Services or create a medical relationship with you.
5. Health questionnaire & self-reported information
- As part of your enrolment, you may be asked to complete a detailed health questionnaire.
- This information is used to help tailor educational content and example exercise plans to your needs, but is based solely on the information you provide and is not independently verified.
- You are solely responsible for ensuring your responses are true, accurate, and complete.
- We are not liable for any injury, loss, or damage arising from incomplete, inaccurate, or misleading information provided by you.
6. Personalised content disclaimer
- Where your program includes content that appears tailored to your situation, it is provided for educational purposes only and is not a clinical prescription or medical treatment plan.
- We recommend that any exercise or nutrition examples provided are reviewed with and approved by your treating healthcare provider before you begin.
- You acknowledge that following our content without professional medical clearance is at your own risk.
7. Medical clearance requirement
We recommend that before commencing any physical activity recommended in our Services, you obtain clearance from your treating healthcare provider, especially if you have:
- A pre-existing medical condition;
- Recently undergone surgery;
- Cardiovascular, respiratory, or metabolic concerns; or
- Any other health issues that may be affected by exercise.
By participating, you confirm you have considered such clearance.
8. Risk acknowledgement
- You acknowledge there are inherent risks in physical activity and surgery preparation exercises, including but not limited to muscle strain, falls, cardiovascular events, and aggravation of existing injuries.
- You voluntarily assume full responsibility for any risks, injuries, or damages, known or unknown, that may result from participating in our program.
9. Your responsibilities
You agree to:
- Participate in the program only if you are physically able and have received clearance from your healthcare provider if needed.
- Follow all safety instructions and program guidelines.
- Stop any activity that causes pain or discomfort and seek professional medical advice.
- Ensure you have a safe environment for exercise.
- Not share your account, program content, or materials with others.
- Not use the Services for commercial purposes or in a manner that infringes on intellectual property rights.
10. Privacy and data handling
We will handle your personal and health information in accordance with our Privacy Policy, available on our website.
By using our Services, you consent to the collection, use, and disclosure of your information as described in our Privacy Policy .
11. Payment terms
- Fees must be paid in full before Services begin, unless otherwise agreed in writing.
- All prices are in Australian dollars and include GST where applicable.
- Access to the Services will commence only once payment is received in full.
12. Refund and cancellation policy
12.1 Cancellations by you:
- You may cancel your enrolment before the program start date by notifying us in writing (email is acceptable).
- If you cancel before the program has started, you will receive a full refund.
- Once the program has commenced — including the release of any program materials or access to the online portal — no refunds will be given for any reason.
12.2 Cancellations by us:
- We may cancel or suspend your access immediately if you breach these Terms, misuse the Services, or act in a way that could harm yourself, others, or our business.
- We may also cancel if we reasonably believe your continued participation may create unacceptable clinical, reputational, or legal risk.
- If we cancel for reasons not related to your breach, you will receive a pro-rata refund for the unused portion of your program.
12.3 Refund process:
- Refunds will be made to your original payment method within 14 business days of approval.
13. Technology requirements
You are responsible for:
- Having a suitable device, internet connection, and browser/software to access our Services;
- Ensuring your device has up-to-date security software;
- Understanding that we are not responsible for issues arising from your hardware, internet provider, or local network.
14. Intellectual property rights
- All materials, content, videos, graphics, text, and branding provided through the Services are owned by or licensed to Prehab Zone Pty Ltd.
- You are granted a limited, non-exclusive, non-transferable licence to use the materials for your personal, non-commercial purposes.
- You must not copy, reproduce, distribute, modify, or adapt any content without our prior written consent.
- Breaching this section may result in immediate termination of access and legal action.
15. Acceptable use and prohibited conduct
You must not:
- Use the Services for unlawful purposes;
- Post or transmit harmful, defamatory, obscene, or offensive material;
- Attempt to hack, disrupt, or interfere with our systems or networks;
- Circumvent security measures or access accounts or content that is not yours.
16. Limitation of liability
- To the maximum extent permitted by law, we exclude all liability for any loss, damage, injury, or claim (including direct, indirect, special, incidental, or consequential damages) arising from your use of the Services, except where caused by our gross negligence or wilful misconduct.
- We are not liable for any adverse outcome resulting from your reliance on our information as if it were personalised medical advice.
- We are not liable for injury or harm resulting from inaccurate self-reported information, failure to obtain medical clearance, or misuse of our Services.
- If liability cannot be excluded by law, our total liability to you will be limited to the amount you paid for the Services in the 12 months prior to the claim.
17. Indemnity
You agree to indemnify and hold harmless Prehab Zone Pty Ltd, its directors, officers, employees, and contractors from and against any claims, damages, losses, liabilities, costs, or expenses (including legal fees) arising from:
- Your breach of these Terms;
- Your misuse of the Services;
- Any claim by a third party related to your participation in the Services.
18. Changes to services or terms
We may amend these Terms or modify the Services at any time. Updates will be posted on our website and will take effect immediately. Continued use of the Services after changes means you accept the revised Terms.
19. Dispute resolution
Before commencing legal proceedings, both parties agree to attempt to resolve disputes in good faith through negotiation. If unresolved, disputes will be referred to mediation in Brisbane, Queensland. If mediation fails, either party may commence legal proceedings in the courts of Queensland.
20. Governing law
These Terms are governed by the laws of Queensland, Australia. You agree to submit to the exclusive jurisdiction of the courts of Queensland.
